Mr. Fortkort serves clients mainly as an intellectual property attorney, but also handles complex commercial litigation and general business issues, including intellectual property licensing. As an expert in V-Chip technology, Mr. Fortkort has successfully negotiated patent licenses with most major television manufacturers on patents related to the new digital television standards. On the patent side, Mr. Fortkort has developed expertise in complex electronic trading technologies, digital television, computer hardware and software, Internet technology, electronic commerce, and many aspects of telecommunications. He has litigated cases involving shareholder derivative suits, antitrust law, business torts, defamation, wrongful seizure, trade dress infringement, copyright infringement, and patent cases involving error correction coding, computer disk drives, microprocessor management, cable television, graphical user interfaces, computer software, and communications devices. He has also drafted software licenses and joint development agreements.
Mr. Fortkort counsels clients in all areas related to patents, including non-infringement, right to use and patentability opinions. He also provides legal assistance and business advice to companies in all stages of development, from start-up to mature enterprise. In this capacity, he helps clients license their technology and negotiate licenses from others. He also helps clients obtain patent litigation insurance by analyzing their potential litigation risk and negotiating with underwriters and their patent counsel. In addition, Mr. Fortkort has spoken at annual meetings for public companies and otherwise helped clients negotiate with investors.
Mr. Fortkort worked as an engineer for the U.S. Army from 1983 to 1990. While there, he developed complex communications related systems, including satellite and terrestrial communications.
